Terms of Use

Updated August 26, 2026

1. Agreement, service and eligibility

These Terms cover the website, native macOS app and licensing services. By using them, or checking the required box inside Polar checkout, you agree to these Terms. If you do not agree, do not use or purchase the product. The Privacy Policy explains data processing, and the Refund & Withdrawal Policy remains available separately.

You must be at least 13 and legally able to contract. Installations first opened during the initial 24-hour launch window do not receive a free trial. A new installation first opened after that window receives one free trial lasting exactly 72 consecutive hours. No payment method is required and the trial does not automatically convert. At expiry, paid features are blocked until activation, but files remain untouched on disk.

2. Plans, prices and promotions

Standard prices are EUR 50 for Lifetime and EUR 8 per month for Monthly. Lifetime is one payment and includes all future versions without a major-version restriction. Monthly renews each month until cancelled.

During the first 24 hours of launch, Lifetime costs EUR 40 and eligible waitlist members can claim a non-transferable Founder Lifetime licence for EUR 20. During the following 6 days, public Lifetime costs EUR 50 and an unclaimed eligible Founder licence costs EUR 25. The Founder offer ends 7 days after launch. Monthly remains EUR 8 throughout.

Supported local-currency prices are fixed in advance. The final plan, currency, tax-inclusive total, renewal schedule and discount displayed at Polar checkout control. Promotions cannot be combined unless checkout expressly says otherwise.

3. Checkout, taxes and delivery

A pricing click opens the selected Polar checkout directly. Before payment, Polar shows a required unchecked field linking these Terms. You must actively check it to continue. That agreement does not waive any right that cannot legally be waived.

Polar is merchant of record and processes payment, applicable indirect taxes, invoices and receipts. Prices shown as final at checkout include applicable tax; a bank may separately charge exchange or payment fees. We do not store full card details. After verified payment, Polar emails the receipt and secure licence portal. A Founder claim is consumed only after verified payment.

4. Renewal and cancellation

Monthly renews automatically every month at EUR 8 or the fixed local price shown at checkout, using the payment method on file. Cancel any time through the Polar portal at https://themarkdowneditor.app/portal. Cancellation stops future renewals and normally keeps access active through the paid period. Cancellation alone does not create a refund.

5. Licence and activations

A purchase grants one personal, non-exclusive, non-transferable licence to use the app, not ownership of it. Up to 3 devices may be active. You may deactivate an old device. Lifetime covers future versions; Monthly is valid while paid and during any displayed technical grace period. Do not publish, sell, share, bypass or reverse engineer a licence key or activation control.

6. Refund, withdrawal and conformity

Purchases do not include a voluntary refund, return period or money-back guarantee. This does not exclude or reduce any right or remedy that cannot legally be waived. Full policy: https://themarkdowneditor.app/refund-policy

Mandatory rights override, including any valid EU/EEA 14-day distance-contract withdrawal and remedies for non-conforming digital content or services. Where law requires a full refund, longer period, repair, replacement, price reduction, termination or another remedy, that remedy applies.

Use the request form at https://themarkdowneditor.app/refunds. You can review the request before sending it. The form sends an email confirmation with the request timestamp. We aim to respond within 2 business days. Mandatory deadlines still apply.

7. Your files, backups and acceptable use

Your local files remain yours and are not deleted by trial expiry, cancellation or licence revocation. Keep independent backups. Do not violate law or third-party rights; distribute malware; evade payment, security or activation controls; share a licence beyond its grant; access accounts or repositories without authorization; or disrupt checkout, licensing, GitHub, updates or analytics.

8. Privacy and third parties

Acceptance is not consent to optional app analytics. Polar handles payment and its portal; Supabase hosts licensing data/functions; Resend delivers email; Vercel hosts the website and cookieless analytics; GitHub supports optional sync/updates; Aptabase provides app analytics; and Apple provides macOS/Keychain. Their terms apply to their services. See https://themarkdowneditor.app/privacy

9. Intellectual property, availability and termination

The app, name, logo, website, design and documentation belong to the operator or licensors, subject to included open-source licences. Services are provided "as is" and "as available" without an SLA. Access may be suspended for fraud, chargeback, refund, material breach or security abuse. A refunded licence may be revoked. Provisions that must survive termination remain in effect.

10. Warranties and liability

To the maximum extent permitted by law, the operator disclaims implied warranties and is not liable for indirect, incidental, special, consequential or punitive loss, including lost files, profits or data. Total liability is limited to the greater of EUR 100 or the amount paid in the preceding 12 months.

Some jurisdictions do not permit particular exclusions or caps. Nothing excludes liability that cannot legally be excluded or limits mandatory consumer rights, conformity guarantees or remedies.

11. Governing law and disputes

The laws of the Republic of Slovenia govern these Terms. This does not override mandatory protections in a consumer's country of residence. Courts with jurisdiction under applicable consumer and procedural law may hear disputes. You may also use any available out-of-court consumer process.

12. Changes and contact

Material changes receive a new date and, where appropriate, notice or renewed acceptance. Continued use after revised Terms take effect constitutes acceptance where permitted; purchase terms are not retroactively changed contrary to law.
